By purchasing goods from Trehane Nursery on this web site you are entering a legally binding agreement with us on the following terms. Please read and understand these terms because they affect your rights and liabilities.
Basis of the sale
An agreement for us to sell you goods is made on these terms when we accept an order made by you via our website and will be confirmed by us sending you an email. The description of the goods, the price and delivery costs are as set out on the web site. All prices include VAT at the current rate, with the exception of blueberry plants and catalogues which are zero rated for VAT.
While we aim to give you a clear description of the plants that we sell, it must be appreciated that there are inevitable variations in size, shape and colour between different specimens. Therefore all images and descriptions of particular plants are approximate and for guidance only.
The goods which can be ordered via our website are only available for delivery to addresses in our Online Delivery Area. (Orders to other UK addresses may be placed by contacting us directly).
Details of the order
The quantity, quality and description of the goods will be those set out in your order and confirmed to you by email from us.
Orders are accepted at our sole discretion, but will normally be accepted if the goods are available, you are based in our Online Delivery Area and your credit or debit card has been authorised for the transaction.
We will inform you as soon as possible if the goods that you have ordered are not available, and under such circumstances we will offer you an alternative or a refund.
Payment
We accept payment in Pounds Sterling by a variety of credit and debit cards (Visa, Mastercard, Maestro, Electron, Solo) powered by RBS WorldPay. The total transaction value will be debited to your card at the point when you place the order. Your card information will be transmitted directly to WorldPay for processing using 128 Bit SSL encryption, so you can trust that your details will be safe when ordering from Trehane Nursery.
Delivery Service and Charges
Orders placed online can only be delivered to addresses within our Online Delivery Area. For further details of this and of our delivery charges please see the Delivery Information page.
We dispatch goods from Monday to Thursday, so that in most cases they will be delivered between Tuesday and Friday. We aim to deliver within 10 working days of the order being placed, but delivery times are not guaranteed. If delivery is unduly delayed due to any cause beyond our reasonable control, we will notify you of the delay.
We will deliver the goods to the address you specify for delivery in your order. If you will not be available to receive the delivery, please advise us of a safe place to leave it, or of a neighbour willing to accept it on your behalf. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions.
Cancellation
You have the right to cancel the order within 7 days from the day after that on which you receive the goods, by notifying us by email or in writing. Return the goods to us in their original condition within 28 days of cancellation in order to obtain a full refund to your credit/debit card. We will not pay the costs of returning items to us.
Until we receive the goods you are returning, they are your responsibility. For your protection and peace of mind, we recommend you use a recorded delivery service.
If on return the plants have been damaged or their condition has deteriorated, we reserve the right to withhold a percentage of the refund value if they need to be reduced in price for resale.
Returns and Refunds
Every effort is made to ensure that the plants supplied are true to type and free of pests and disease, but we cannot guarantee that this is the case. In the event of a complaint that the plants supplied are incorrect, are of poor quality or have been delivered in a damaged state, you must notify us by email, telephone or fax within 24 hours of their receipt. In the case of plants that have been damaged in transit please retain all wrappings for any subsequent investigation. We will replace damaged plants.
While we take every care to produce and dispatch top quality plants, we cannot guarantee that they will grow once they are in your care. However, should any of our plants fail to survive we will investigate any complaint fairly and with courtesy.
Risk and ownership
Risk of damage to or loss of the goods passes to you at the time of delivery to you or, if you fail to take delivery at the agreed time, the time when we tried to deliver.
You will only own the goods once they have been successfully delivered and when we have received cleared payment in full.
Privacy Policy
Trehane Nursery operates a strict privacy policy in accordance with the Data Protection Act 1998. We will only collect personal information about you in order to fulfil your order, and we will not pass your details to any third party. It is not our policy to send unsolicited marketing material or emails to our customers.
Law & Jurisdiction
Purchases of goods on this web site are governed by English Law and will be deemed to have taken place in England and subject to the exclusive jurisdiction of the English Courts.
